CHRIS CASEIRO SUCCESSFULLY DEFENDED A REEXAMINATION PROCEEDING AT THE UNITED STATES PATENT AND TRADEMARK OFFICE

Caseiro Burke is pleased to announce that Chris A. Caseiro successfully defended against a reexamination proceeding filed against our client by one of its competitors. An Ex Parte Reexamination occurs when a third party (or the owner of the patent) petitions the United States Patent and Trademark Office (the “USPTO”) to reexamine a patent to verify that the subject matter described in the patent is patentable.

In this matter, a competitor of our client petitioned for reexamination alleging that the method patent was invalid in view of a number of references the competitor contended described our client's method. In response to the petition, Attorney Caseiro argued that the cited references failed to describe each step of the method claimed in our client's patent. After reviewing both Parties' arguments, the USPTO agreed with Attorney Caseiro and the reexamination was terminated leaving all the claims in the patent intact.

According to the USPTO, more than 75% of reexaminations approved by the USPTO result in a limitation of the claims or a complete cancellation of the patent. That was not the case here. Congratulations to our client on this excellent outcome!
